Introduction

Tryozi Group LLC ("Tryozi," "we," "us") owns and operates this website (the "Website"). By accessing the Website, you agree to these Terms of Use, which govern all services, features, content, and applications we provide. Clinical care, prescribing, and fulfillment are provided by licensed clinicians and pharmacies through OpenLoop Health, Inc. and its affiliated medical groups; your use of those services is also subject to OpenLoop's applicable terms and the Telehealth Informed Consent.

1. Privacy

Review our Privacy Policy / Notice of Privacy Practices regarding personal information and Protected Health Information.

2. Changes to Terms

We may revise these Terms at any time. Changes become effective upon posting; continued use constitutes acceptance unless law requires additional notice.

3. The Website Does Not Provide Medical Advice

The information and content on the Website is for informational purposes only and is not a substitute for professional medical advice. Consult a licensed clinician about your medical condition. A prescription is provided only if a licensed clinician determines it is appropriate.

4. Reliance on Information Posted

We disclaim liability for the accuracy or completeness of information on the Website. You rely on posted materials at your own risk. Individual results vary.

5. Communications; Electronic Notices and Signatures

You consent to receive communications from us electronically — by email or through notices posted on the Website — and you agree that electronic signatures, contracts, and other records satisfy any legal requirement that such communications be in writing. You may opt out of promotional email at any time using the unsubscribe link in any message. Text messaging is separate: we send text messages only if you opt in, on the terms set out in Section 6 below.

6. Mobile Messaging (SMS) Terms of Service

Program. Tryozi Group LLC operates two text-message programs. Tryozi Alerts sends service and order messages — order confirmations, shipping and delivery updates, refill and check-in reminders, and account notices. Tryozi Offers sends promotional messages — plan pricing, offers, and program news. You may enroll in either, both, or neither.

How you opt in. You are enrolled only when you provide your mobile number and check the separate consent box for that program during signup on our intake at tryozi.com/join/glp1. Each program has its own consent box, which is unchecked by default; enrolling in one does not enroll you in the other. Agreeing to these Terms of Use does not enroll you in either program, and consent to receive promotional text messages is not a condition of purchasing anything from us.

How you opt out. Reply STOP to any message. We will send one final message confirming that you have been unsubscribed. After that final message, you will no longer receive SMS messages from us unless you re-enroll in the SMS program. You may also opt out by emailing support@tryozi.com.

How to get help. If you require help or assistance with your SMS messages, reply HELP to any message for additional information, or reach out directly at support@tryozi.com or (336) 365-0623.

Message frequency. Message frequency varies.

Cost. Message and data rates may apply for any messages sent or received. Check the plan you have with your mobile carrier; we are not responsible for carrier charges.

Delivery. Carriers are not responsible for delayed or undelivered messages. We cannot ensure that any message will be delivered, and supported carriers may change.

Your information. Data obtained through the SMS program will not be shared with any third parties for their marketing reasons/purposes. For more information, please review our Privacy Policy.

Health information. Messages may reference your order or your care. Text messaging is not a secure or confidential channel, and messages may be visible to anyone with access to your phone. If you would prefer not to receive health-related messages by text, do not opt in, or reply STOP at any time.

Not for emergencies. Never use text messaging to report a medical emergency. Call 911 or go to the nearest emergency room; the 988 Suicide & Crisis Lifeline is available by call or text at 988.

7. Changes to the Website

We may update Website content without obligation to maintain current information.

8. Ownership of Website and Content

The Website and its content are the exclusive property of Tryozi Group LLC or its suppliers and are protected by intellectual-property laws.

9. Trademarks

The Tryozi name, logo, and related marks may not be used without our prior written permission. Other marks belong to their respective owners. Product imagery on this site excludes third-party branding; we are not the compounder of any medication.

10. Your Use of the Website

You may use the Website for personal, non-commercial purposes only. Prohibited: reproducing content, impersonating Tryozi, using automated tools/scrapers, introducing malware, or attempting unauthorized access.

11. Pharmacy and Fulfillment; Shipping

Prescriptions are fulfilled through partner pharmacies coordinated by OpenLoop. Prescriptions may be transferred among partner pharmacies for fulfillment reasons. Follow all storage and handling instructions on shipment.

12. Payment; Subscriptions; Automatic Renewal

By providing payment information, you authorize charges for the services you select plus applicable taxes. Subscription plans renew automatically until cancelled per the Cancellation & Refund Policy. The total cost of your plan — and what it includes — is disclosed before payment. Accepted methods: Visa, Mastercard, FSA/HSA, Apple Pay, Google Pay (American Express not accepted). We do not store full payment card numbers.

13. Refunds

Refunds are governed by the Cancellation & Refund Policy and applicable law.

14. Termination

We may suspend or terminate access for any reason. Provisions that by their nature survive termination (warranty disclaimers, limitation of liability, dispute resolution) continue to apply.

15. Links from the Website

Third-party links are provided for convenience; we do not control or endorse them.

16. Disclaimer of Warranties

The Website and its content are provided "AS IS" and "AS AVAILABLE." We disclaim all warranties, including merchantability and fitness for a particular purpose.

17. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages arising from your use of the Website. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Website will not exceed the greater of the amounts you paid to Tryozi in the twelve (12) months preceding the claim or USD $100. Your sole remedy for dissatisfaction with the Website is to discontinue use. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

18. Indemnification

You agree to defend and indemnify Tryozi Group LLC and its affiliates from claims arising from your violation or misuse of the Website.

19. Governing Law

These Terms and any dispute arising out of or relating to them or the Website are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, except to the extent federal law applies.

20. Dispute Resolution

Please read this section carefully — it affects your legal rights.

Informal resolution first. Before starting a formal proceeding, you agree to contact us at legal@tryozi.com and give us at least sixty (60) days to resolve the dispute informally.

Binding arbitration. If we cannot resolve the dispute informally, you and Tryozi agree that any dispute relating to the Website will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will be seated in Broward County, Florida, or conducted remotely where available.

Class-action waiver. You and Tryozi agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding.

Opt-out. You may opt out of this arbitration agreement by emailing legal@tryozi.com within thirty (30) days of first accepting these Terms.

21. Severability

If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

22. Geographic Restrictions

Services are offered in the United States. Availability varies by state and is subject to change.

23. Entire Agreement

These Terms, together with the Privacy Policy and Telehealth Informed Consent, constitute the entire agreement regarding the Website.
